The Romiche: Intellectual Property Infringement Policy

The Romiche offers an online platform for users to design and sell their own merchandise. We take intellectual property rights seriously and prohibit users from creating or selling products that violate copyright, trademark, or other related laws. If you believe your intellectual property has been infringed on The Romiche, please follow the steps outlined below.

Reporting Infringement

The Romiche will address infringement claims promptly. Here’s the process:

  • Send a Notice: Include the following in your notice to our Designated Agent:
  • Description of your copyrighted work or other protected intellectual property.
  • Location of the infringing content on The Romiche with enough details for us to locate it.
  • Your contact information (name, address, phone, email).
  • Statement of good faith belief that the use is unauthorized.
  • Statement, under penalty of perjury, that your information is accurate and you are the rights holder (or authorized to act on their behalf).
  • Your digital or physical signature.
  • Romiche’s Response

Upon receiving a valid complaint, The Romiche will:

  • Remove or disable access to the infringing material.
  • Notify the user who posted the content.
  • Terminate repeat offenders’ access to The Romiche.
  • Submitting a Counter-Notice

If you believe your content was removed in error or that you have the right to use it (e.g., fair use), send a counter-notice to our Designated Agent. Include:

  • Identification of the removed content and its original location on The Romiche.
  • Statement, under penalty of perjury, that the removal was a mistake or misidentification.
  • Your contact information.
  • Consent to the jurisdiction of the relevant federal court.
  • Your digital or physical signature.
  • Upon receiving a counter-notice, The Romiche may notify the original complainant and restore the content within 10-14 business days unless legal action is taken by the rights holder.

Important: Knowingly misrepresenting infringement can result in liability for damages, including legal fees, under Section 512(f) of the DMCA.
